These Terms and Conditions (the “Terms”) govern your access to and use of the Govar website, platform, and related services (together, the “Services”). By accessing or using the Services, you agree to these Terms.

If you do not agree, do not use the Services.


1. Who we are

“Govar”, “we”, “us”, or “our” means Govar Inc, a company incorporated in Delaware with its registered office at 131, Continental Dr ,Suite 305, Newark, DE, 19713 US

2. Eligibility and account registration

You must be at least 18 years old and capable of entering into a binding contract to use the Services.

You may need an account to access certain features. You agree to:

  • Provide accurate information.
  • Keep your login details secure.
  • Notify us promptly if you suspect unauthorised access.

You are responsible for all activity on your account.


3. What Govar does

Govar provides a technology platform that may include:

  • Guided questionnaires and eligibility checks.
  • Document collection and workflow tools.
  • Case tracking and collaboration tools.
  • Drafting support for non-legal content (for example, checklists, supporting letters, personal statements) where permitted.
  • Matching you with independent immigration lawyers and advisers (the “Professionals”) where available.


Important: Govar is not a law firm and does not provide legal advice. Any legal advice is provided only by Professionals you engage, under their own terms.


4. Not legal advice, no attorney-client relationship with Govar

Information provided through the Services (including automated outputs) is for general information and workflow support only and is not legal advice.

Using Govar does not create an attorney-client, adviser-client, fiduciary, or similar relationship between you and Govar. If you choose to work with a Professional, your legal relationship is with that Professional, not Govar.


5. Professionals and third-party services

If you engage a Professional through the Services:

  • The Professional is independent and not an employee, agent, or partner of Govar.
  • The Professional may have separate engagement terms, scope, timelines, and fees.
  • Govar does not guarantee outcomes, decisions, or processing times for any government application.

Government websites, fees, biometrics, and appointment providers are third parties. Govar is not responsible for their availability, changes, outages, or decisions.


6. Scope boundaries and prohibited use

You agree not to:

  • Use the Services for unlawful purposes.
  • Submit false, misleading, or forged information.
  • Attempt to access systems or data you do not have permission to access.
  • Scrape, reverse engineer, or disrupt the Services.
  • Use the Services to provide immigration advice to others unless you are authorised and licensed to do so in your jurisdiction.

We may suspend or terminate access if you violate these Terms.


7. Your responsibilities

You are responsible for:

  • Ensuring the information you provide is accurate, complete, and truthful.
  • Reviewing any outputs, drafts, or checklists before use or submission.
  • Meeting all deadlines (including government deadlines) and following instructions from Professionals you engage.
  • Keeping copies of all documents you submit.


8. Fees, billing, and taxes

Some Services are free; others require payment.

When you purchase a paid Service, you agree to:

  • Pay the listed fees and applicable taxes.
  • Provide valid payment details.
  • Authorise us or our payment processor to charge your payment method.

If you purchase services from a Professional, those fees may be charged by Govar on the Professional’s behalf or by the Professional directly, depending on the flow shown at checkout.


9. Refunds and cancellations

Refund eligibility depends on what you purchased and what work has started or been delivered.

Your refund rights and cancellation options are described in the Refund Policy and any checkout-specific terms shown at purchase. If there is a conflict, the checkout terms apply to that purchase.

Note: Government fees are typically non-refundable. Professional fees may be non-refundable once work has started, depending on the Professional’s engagement terms.


10. Service changes and availability

We may modify, suspend, or discontinue parts of the Services at any time, including features, pricing, and availability.

We aim to keep the Services available, but do not guarantee uninterrupted operation.


11. AI and automated features

Some features may use automation or AI to summarise, draft, classify, or recommend next steps based on the information you provide.

You acknowledge that:

  • Automated outputs may contain errors or omissions.
  • You must verify outputs before relying on them.
  • Automated features do not replace professional legal advice.


12. Intellectual property

We own or license all intellectual property in the Services, including software, text, design, and trademarks, except where stated otherwise.

You receive a limited, non-exclusive, non-transferable licence to use the Services for your internal or personal/business immigration needs.

You may not copy, modify, distribute, sell, or create derivative works from the Services unless we give written permission.


13. User content and permissions

“User Content” includes information, documents, and data you upload or submit.

You retain ownership of your User Content. You grant Govar a licence to host, store, process, and display your User Content solely to provide and improve the Services, including:

  1. Running eligibility checks and generating drafts you request.
  2. Sharing information with Professionals you explicitly choose to engage or collaborate with.
  3. Preventing fraud, securing the platform, and complying with legal obligations.

You represent that you have the rights to upload the User Content and that it does not violate any laws or third-party rights.


14. Privacy and data protection

Our Privacy Policy explains how we collect, use, and protect personal data.

If you use the Services on behalf of a company, you confirm you have the authority to share personal data of employees or candidates and that you will comply with applicable privacy laws.


15. Confidentiality

We treat your information as confidential, as described in the Privacy Policy.

However, communications with Govar are not protected by legal professional privilege. Privilege may apply only to communications directly with a Professional, depending on jurisdiction and the engagement.


16. Disclaimers

To the maximum extent permitted by law:

  • The Services are provided “as is” and “as available”.
  • We do not warrant that the Services will be error-free or meet your specific needs.
  • We do not guarantee any immigration outcome, timeline, or decision.


17. Limitation of liability

To the maximum extent permitted by law, Govar will not be liable for:

  1. Indirect, incidental, special, consequential, or punitive damages.
  2. Loss of profits, revenue, goodwill, data, or business opportunities.
  3. Any decisions or actions by government authorities or third-party providers.
  4. Acts, omissions, negligence, or misconduct of independent Professionals.


Our total liability for any claim relating to the Services will not exceed the amount you paid to Govar for the specific paid Service giving rise to the claim during the three months before the event, or $100, whichever is higher, unless applicable law requires otherwise.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.


18. Indemnity

You agree to indemnify and hold Govar harmless from claims arising out of:

  • Your misuse of the Services.
  • Your violation of these Terms.
  • Your User Content, including if it infringes third party rights or is false or unlawful.


19. Termination

You may stop using the Services at any time.

We may suspend or terminate your access if:

  • You violate these Terms.
  • We must do so to comply with law.
  • We believe your use creates risk or harm to Govar, other users, or Professionals.

Termination does not affect accrued rights or obligations, including payment obligations.


20. Governing law and dispute resolution

These Terms are governed by the laws of Delaware, without regard to conflict of laws principles.

Courts located in Newark, Delaware, will have exclusive jurisdiction, except where consumer protection laws provide otherwise.

Before filing a claim, you agree to contact us at support@govar.com and to allow 30 days to resolve the issue.


21. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide notice by updating the “Last updated” date and, where appropriate, providing additional notice within the Services.

Your continued use after changes means you accept the updated Terms.


22. Miscellaneous

  • Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights to an affiliate or successor.
  • Severability: If any provision is unenforceable, the rest remain in effect.
  • No waiver: Failure to enforce a right is not a waiver.
  • Entire agreement: These Terms, plus any policies referenced (including Privacy and Refund Policy), form the entire agreement regarding the Services.
